Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the ARt_ifact application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. The App is operated by Enigmatic LLC ("we," "our," or "us").

2. Eligibility

You must be at least 13 years old to use ARt_ifact. By using the App, you represent that you meet this age requirement. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration

You may create an account using Sign in with Apple, Google Sign-In, or email and password. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms or our Community Guidelines.

4. User-Generated Content

4.1 Your Content

You retain ownership of the content you create and place through the App (photos, audio, text, 3D models, and other media). By sharing content publicly, you grant ARt_ifact a non-exclusive, worldwide, royalty-free license to display, distribute, and make your content available to other users through the App.

4.2 Content Responsibilities

You are solely responsible for the content you create and share. You agree not to post content that:

  • Is illegal, harmful, threatening, abusive, harassing, or defamatory
  • Contains explicit, violent, or sexually suggestive material
  • Infringes on intellectual property rights of others
  • Contains hate speech or promotes discrimination
  • Impersonates another person or entity
  • Contains spam, malware, or deceptive content
  • Shares personal information of others without consent
  • Could endanger the safety of minors

4.3 Content Moderation

We reserve the right to review, moderate, and remove any content that violates these Terms or our Community Guidelines. Content may be reviewed through automated systems and manual review. We may take action including content removal, account warnings, temporary suspension, or permanent termination.

5. Community Guidelines

All users must follow our Community Guidelines, which are incorporated into these Terms by reference. The Community Guidelines provide detailed rules about acceptable behavior, prohibited content, and enforcement procedures.

6. Safety and Physical World Interactions

ARt_ifact involves augmented reality experiences in the physical world. You agree to:

  • Always be aware of your physical surroundings when using AR features
  • Not use the App while driving, cycling, or operating machinery
  • Not trespass on private property to access or place AR content
  • Not place content in locations that could endanger others
  • Follow all local laws and regulations while using the App

We are not responsible for injuries, accidents, or property damage that may occur while using AR features. Use the App at your own risk and always prioritize physical safety.

7. Intellectual Property

The App, including its design, features, code, and branding, is owned by Enigmatic LLC and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Reporting and Blocking

You can report objectionable content or users through the in-app reporting features. You can also block or mute users to control your experience. We investigate reports and take appropriate action in accordance with our Community Guidelines.

10. Account Deletion

You may delete your account at any time through the App's Settings. Account deletion will remove your profile, content, and associated data from both private and public databases. This action is permanent and cannot be undone.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. AR CONTENT PLACED BY OTHER USERS IS NOT ENDORSED OR VERIFIED BY US.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENIGMATIC LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO PHYSICAL INJURY, PROPERTY DAMAGE, OR DATA LOSS.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the App. Your continued use after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
